Terms of Service

1. The Service

YieldShield provides safety intelligence reports, monitoring, and related tools for motor carriers regulated by the Federal Motor Carrier Safety Administration (FMCSA). The service aggregates, summarizes, and presents publicly available regulatory data (USDOT registration records, inspection selection metrics, and authority statuses) in a single-carrier report format.

By accessing or using YieldShield, you agree to these terms. If you do not agree, do not use the service. The service is intended for business use by persons who are at least 18 years old and able to form a binding contract.

2. Data Sources

All carrier safety data displayed on YieldShield is derived from public data published by the FMCSA, including the Safety Measurement System (SMS) and the Motor Carrier Management Information System (MCMIS) census files. YieldShield is not affiliated with, endorsed by, or sponsored by the FMCSA, the U.S. Department of Transportation, or any government agency.

FMCSA data is refreshed on the FMCSA's publication schedule, typically monthly. The data shown on any page reflects the most recent snapshot we have ingested, indicated by the "as of" date in the footer. Data may be incomplete, delayed, or superseded by later FMCSA publications.

3. No Guarantee; No Professional Advice

YieldShield reports are informational only. They are not legal advice, insurance advice, compliance advice, or a substitute for consultation with a qualified attorney, broker, or compliance professional. Scores, tiers, and derived metrics (including Inspection Selection System values and related bands) are computed from public inputs and may differ from figures used by regulators, insurers, or enforcement personnel at any given time.

We make no warranty that the service will be uninterrupted, error-free, or that the data presented is accurate, complete, or current. The service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

4. Limitation of Liability

To the maximum extent permitted by law, YieldShield and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including lost profits, lost revenue, business interruption, fines, penalties, or increased insurance premiums) arising from or related to your use of, or inability to use, the service, even if advised of the possibility of such damages.

Our total aggregate liability for any claim arising out of the service shall not exceed the greater of (a) the amount you paid to YieldShield in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100).

5. User Responsibilities

  • You will not scrape, bulk-download, or redistribute report data. Reports are licensed for single-carrier, individual use.
  • You will not use the service to harass carriers, misrepresent safety records, or make hiring, lending, or insurance decisions prohibited by applicable law.
  • You are responsible for the accuracy of any information you submit (e.g., email addresses for alerts, billing details).
  • You will not attempt to circumvent access controls, rate limits, or paid feature gates.

6. Paid Services & Billing

Paid features are billed through Stripe. By purchasing, you authorize the charge described at checkout. Except where required by law, payments are non-refundable once the associated report or service has been delivered. Subscription services may be cancelled at any time and remain active through the end of the current billing period.

7. Intellectual Property

The YieldShield name, site design, report formats, scoring methodology presentations, and all software and content we author are owned by YieldShield or its licensors. Underlying FMCSA data is public; our selection, arrangement, derived metrics, and presentation of it are not. These terms grant you no rights in our trademarks or content beyond the individual, single-carrier use described in Section 5.

8. Termination

We may suspend or terminate your access to the service (including any account) at any time, with or without notice, if we reasonably believe you have violated these terms, abused the service, or created risk or legal exposure for us. You may stop using the service at any time; paid subscriptions remain governed by Section 6. Sections 3, 4, 7, 9, and 12 survive termination.

9. Governing Law; General

These terms are governed by the laws of the United States, without regard to conflict of law principles. Any dispute arising out of these terms or the service shall be resolved in the courts of the United States, and you consent to their jurisdiction.

If any provision of these terms is held unenforceable, the remaining provisions remain in full force. These terms, together with the Privacy Policy, are the entire agreement between you and YieldShield regarding the service.

10. Modifications

We may modify these terms at any time. Material changes will be reflected in the "Last updated" date above. Continued use of the service after changes take effect constitutes acceptance of the revised terms.

12. Refund & Money-Back Guarantee Policy

All YieldShield subscription plans (Pulse, Shield, and Shield Plus) include a money-back guarantee as described below. If the applicable guarantee conditions are met, YieldShield will issue a full refund of subscription fees paid during the guarantee period.

  • Pulse ($29/mo): If we don't catch at least one NEW revenue leak within 30 days of your subscription activating, full refund.
  • Shield ($49/truck/mo) & Shield Plus ($99/truck/mo): If the software doesn't detect at least one challengeable violation on your record within your first 60 days of monitoring, full refund of your first two months.

To request a refund under this guarantee, contact support@getyieldshield.com. This guarantee does not apply to one-time service purchases, which are governed by the individual product guarantee terms described at the time of purchase.
